Public Offer for the use of the “Okolica” software

This document is an official proposal (public offer) addressed to any person (the “User”) to enter into an agreement for the use of the “Okolica” web software (the “Software”, the “Service”) on the terms set out below. Using the Service constitutes full and unconditional acceptance of the terms of this offer.

1. Definitions

  1. Developer — the person providing access to and maintenance of the Okolica Software (contact details are given in the “Details” section).
  2. Software / Service — the “Okolica” web application for estimating window and door units, bills of materials, orders and reports, available at okolica.org.
  3. User — an individual or legal entity using the Service.
  4. Acceptance — the User's full acceptance of the terms of the offer by starting to use the Service.

2. Subject of the offer

  1. The Developer grants the User the right to use the Service to the extent of the chosen access level: explore, demo (personal cabinet) or subscription.
  2. The functionality of each level is described at okolica.org and may be specified by the Developer.
  3. The Service is provided remotely over the Internet; no installation on the User's equipment is required.

3. Acceptance and provision of access

  1. The explore level is provided freely and is intended solely for reviewing and evaluating the Service.
  2. The demo level (a personal cabinet with a separate database) is provided upon the User's request; credentials are shared by the User with the Developer voluntarily.
  3. A subscription is arranged upon a separate request and defines the available set of hardware, profile systems and functionality.

4. Rights and obligations of the parties

  1. The User undertakes to use the Service for its intended purpose and in accordance with applicable law, and not to impair the operation of the Service or the rights of third parties.
  2. The User is solely responsible for the accuracy of entered data and for verifying the results of calculations before using them in production.
  3. The Developer makes reasonable efforts to keep the Service stable but does not guarantee uninterrupted or error-free operation.
  4. The Developer may change the functionality, composition and terms of the Service, and suspend it for maintenance.

5. Disclaimer of warranties and limitation of liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, express or implied.

The Developer bears no financial (material) liability whatsoever for any losses — direct or indirect, including lost profits, loss or corruption of data, production downtime or any other damage — arising from the use of or inability to use the Service, including as a result of errors, failures, inaccuracies or any other incorrect operation of the software.

All calculations, specifications and documents produced by the Service are of an auxiliary nature. The User must independently verify their correctness and assumes all risks associated with their use. The Developer's aggregate liability on any grounds is limited to zero, except where otherwise expressly required by law.

6. Personal data

  1. Account and contact data provided by the User are used solely to provide access to the Service and to communicate with the User.
  2. The Developer takes reasonable measures to protect the data provided and does not disclose it to third parties except as required by law.

7. Final provisions

  1. The Developer may unilaterally amend the terms of this offer; the current revision is published at the address of this page.
  2. Continued use of the Service after the terms change constitutes acceptance of the new revision.
  3. Matters not covered by this offer are governed by applicable law.
